Anyone has the right to object to their image being broadcast without their consent.
In the case of images filmed on the public highway, the explicit consent of the person filmed is required if that person is isolated and identifiable. You must obtain the person’s consent in writing before you can use their image.
This consent must be precise, specifying the medium on which the image will be broadcast, the purpose and the duration.
In the case of minors, parental consent is required.
If you are filming on the public highway, remember to prepare image rights authorisations for the people who will be in the shot:
- the name of the production ;
- the name of the project ;
- the name of the director;
- the context of the shots and the use to which they will be put;
- the date ;
- the signature of the person filmed.
In some cases, the permission of the people filmed is not required, except for commercial purposes and with due respect for their dignity.
These cases are listed below:
- image of a group or street scene in a public place if no individual is portrayed and within the limits of the right to information ;
- image of a current event or public demonstration within the limits of the right to information and artistic creation;
- an image of a public figure in the performance of his or her duties if the purpose of the image is to inform;
- images illustrating a historical subject.
